A cash box used to hold casino chips fell on his foot and that’s why Justyn Tyndaal is now claiming damages as the incident caused serious injuries, according to a lawsuit filed at Rockingham County Superior Court.<\/p>\n
During one if its daily tournaments, the incident took place at Rockingham Park’s poker room. When the box came loose it somehow struck him while Tyndaal was taking part in the poker tournament.<\/p>\n
Major Injuries Lead to Lawsuit<\/strong><\/p>\n Tyndaal claims to have witnesses who can back up his story of events saying that he suffered “severe pain” following the impact.<\/p>\n Tyndal suffered from emotional distress, partial disability, disfigurement, and of course loss of earnings.<\/p>\n “The end result is a string of medical expenses and the potential for further discomfort in the future thanks to the “serious and permanent injuries” Tyndaal suffered”.<\/p><\/blockquote>\n To cover the poker player’s expenses, Francis Caruso, Tyndaal’s attorney, is pushing for a financial settlement and a jury trial, despite the average cash box measuring no more than six inches.<\/p>\n However, the company in charge of the poker, Rockingham Gaming LLC, hasn’t felt pressured to comment on the issue further as no paperwork has been received yet.<\/p>\n A judge has to decide if the poker player’s injuries justifies compensation. Tyndaal may have however mad a wrong move if he’s just using this to earn back his tournament entry fee.<\/p>\n Whether this is the motive or not, poker players turned out to be unsuccessful in taking on casinos in court. Phil Ivey is not getting anywhere fast in his fight against Atlantic City’s Borgata for the amount of $9.6 million.<\/p>\n In addition, the players that were forced to take an ICM payout in the Borgata “chipgate” scandal after counterfeit chips were discovered, haven’t been very successful.<\/p>\n The case was taken to court as that wasn’t good enough for the players.
