As per those charges, Postle is facing counts of\ncheating, unjust enrichment, negligence, and fraud for a whole lot of 11\ncauses. <\/p>\n\n\n\n<p>The amendment in the original charges brought the number of plaintiffs from mere 25 to 89 people who have a reason to be miffed at Postle. On the other side, there are <a href=\"https:\/\/www.onlinepokeramerica.com\/news\/mike-postle-and-defendants-request-for-more-time-to-respond\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Mike Postle<\/a> and <strong>Stones Gambling Hall<\/strong> as well as <strong>Justin Kuraitis<\/strong>, a tournament direct at Stones. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"the-story-so-far-dismissing-the-complaint\">The Story So Far \u2013 Dismissing the Complaint<\/h2>\n\n\n\n<p>On <strong>April\n8<\/strong>, Stones Gambling Hall filed a notice of motion hoping to toss the first complaint\nout of the way. Stones Gambling Hall is represented by <strong>King\u2019s Casino\nManagement Corporation<\/strong>. The motion cleverly exploits a popular legal safe\nin such matters, that the plaintiffs claim foul play when in reality &#8211; the\ndefense says \u2013 the plaintiffs\u2019 own bad luck had got the better of them. Hence,\nPostle couldn\u2019t have cheated \u2013 he simply outplayed his opponents, the logic\ngoes.<\/p>\n\n\n\n<p>The Internet has proliferated with careful, naked-eye analyses of Postle\u2019s suspicious and irrational playstyle which, even players beyond the affected group of participants <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.washingtonpost.com\/lifestyle\/magazine\/when-a-poker-commentator-suspected-a-player-of-cheating-she-called-this-lawyer\/2020\/01\/24\/2fb609a2-2b2a-11ea-bcb3-ac6482c4a92f_story.html\" target=\"_blank\">in the live-streamed low-stakes game<\/a> that Postle took part in, have agreed indicated foul play. Yet, his cheating might have run for years, some have alleged although there is scant evidence without a verdict. Some of the people to rail against Postle include <strong>Marle Cordeiro<\/strong>, a poker player herself and an established figure in the poker community. <\/p>\n\n\n\n<p>In their\nmotion, King\u2019s basically lets their lawyers explain very shortly that <em>\u201cgambling-related\nlosses are not cognizable as damages,\u201d <\/em>putting a legal twist on it, but\nstill not coming close to exonerating Postle from having his reputation sullied.\n&nbsp;<\/p>\n\n\n\n<p>According\nto the motion and the defense prepared by lawyers, the claim for <em>\u201cfraud,\nconstructive fraud, and negligent misrepresentation is short of the Federal\nRules of Civil Procedure Rule 8 and 9b\u2019s pleading standards\u201d<\/em><\/p>\n\n\n\n<p>The defense\nfurther claims that plaintiffs have no way of proving negligence nor fraud\nbecause they rely on unconfirmed facts. The defense went so far as to call those\nunconfirmed facts \u201cinnuendos\u201d and \u201cinsinuations.\u201d <\/p>\n\n\n\n<p>Kuraitis also joined King\u2019s Casino Management\u2019s dismiss motion arguing that some of the plaintiffs, including <strong>Veronica Brill<\/strong> and <strong>Kasey Lyn Mills<\/strong>, and <strong>Marc Goone<\/strong>, had no reason to rely on his, i.e. Kuraitis\u2019 statements, to arrive at the conclusion that Postle had cheated. <a href=\"https:\/\/www.tmz.com\/2020\/04\/06\/marle-cordeiro-sues-poker-player-mike-postle-cheating-via-cell-phone\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Cordeiro is also among the plaintiffs<\/a> who is determined to see the case through. <\/p>\n\n\n\n<p>A pretrial\nscheduling has been set up for July 20, but this may now be postponed depending\non how long the coronavirus pandemic stretches. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"are-stones-gambling-hall-saying-they-owe-nothing-to-gamblers\">Are Stones Gambling Hall Saying They Owe Nothing to Gamblers?<\/h2>\n\n\n\n<p>One thing\nthat stands out in Stones Gambling Hall defense is what the team of lawyers\nhave thought would hold up in court:<em> \u201cCasinos do not owe a general duty of\ncare to gamblers.\u201d <\/em>In other words, the very people who frequent a venue to\nplay poker competitively aren\u2019t owed a thing, and this is true in principle.<\/p>\n\n\n\n<p>Poker\nplayers are a competitive lot who fully understand that skill alone would\ndetermine the outcome. While Stones may not have a legal obligation to make\namendments, solving the case in players\u2019 favor would have been the honorable\nthing to do.
